All information gathered in connection with this agreement will be used solely for identification of the Consignor, for communications with the Consignor and for internal analytics. We will not sell your information or make it available to any third party for any use other than that of reFind's as stated above.
This agreement replaces any and all previous agreements between the Consignor and reFind clothing & décor Ltd.
IN CONSIDERATION OF the mutual benefits of reFind accepting, displaying and otherwise attempting to sell items consigned to reFind by the Consignor, the parties to this Agreement agree to the following:
reFind agrees:
- To treat the Consignor's consigned items with due care until such time as the items are removed from the sales floor.
- To display the Consignor's items for sale.
- To make and maintain efforts to sell the Consignor's items using reFind's best-known practices.
- To keep accurate records of credit owed to the Consignor and to make credit and credit information available to the Consignor in accordance with the Policies.
- That at any time, during or after the consignment period, if the Consignor's items are sold, the Consignor will be credited accordingly.
The Consignor agrees:
- To read and understand the current Consignment Policies (the Policies).
- To re-read and understand the Consignment Policies at the time that the Consignor consigns any items.
- That the minimum Consignment Period is specified in the Consignment Policies and may change from time to time. Any item may remain on the sales floor until such time as reFind removes the item. Items may not be removed from the sales floor by the Consignor.
- Items that are unsold after the Consignment Period may be removed from the sales floor at the discretion of reFind or at the request of the Consignor. All items will be removed by reFind.
- Items that are removed from the sales floor will become the property of reFind and may be donated at the discretion of reFind. This is unless the items are removed at the request of the consignor and the consignor retrieves the items in accordance with the Policies.
- The Consignor will receive 40% of the selling price of any items sold in-store. If reFind sells the consigned items by an alternate means or venue, the Consignor will receive 40% of the proceeds received by reFind.
- reFind will issue cheques for consignor credit at the request of the Consignor. reFind may charge a fee to the consignor's account for issuing cheques or other payment methods. reFind may also charge a fee for mailing cheques. All fees will be outlined in the policies.
- That if any consigned item is lost, damaged or stolen, reFind is not obligated to pay the consignor for the item.
- reFind is not obligated to pay consignors for any unsold items.
Consignor agrees that reFind (including its employees and shareholders) reserve the right to:
- Refuse to consign any item.
- Dispose of any item found to be damaged or otherwise unlikely to sell, at any time before, during or after the consignment period.
- Price items with or without input from the consignor. Pricing is at the sole discretion of reFind.
- Decide when an item will go on the sales floor.
- Donate any item after the consignment period specified in the current consignment policies.
- Reduce or increase the price of an item in order to sell that item for the mutual benefit of the Consignor and reFind.
